rescreativa.org
Res Creativa is committed to protecting your privacy. This policy explains what personal data Res Creativa collects when you visit rescreativa.org, use our forms, subscribe to our newsletter, or leave a comment, and what rights you have over that data.
Overview of Data Processing
We take the protection of your personal data seriously and handle it in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) for visitors located in the European Union or European Economic Area.
Personal data means any information that identifies you, such as your name, email address, or IP address. The sections below describe each way we collect and use this data, the legal basis for doing so, and how long we retain it.
Who Is Responsible for Your Data
Res Creativa, at the address above, is the data controller for this website. If you have questions about this policy or want to exercise any of the rights described below, contact us at contact@rescreativa.org.
Hosting and Server Log Files
Our hosting provider collects and stores information that your browser automatically transmits, including your IP address, browser type and version, operating system, referring URL, date and time of access, and the pages you request. This data is stored in server log files and is used to ensure the technical stability and security of the site.
This processing is based on our legitimate interest in operating a secure and functional website (Art. 6(1)(f) GDPR). Log data is retained only as long as necessary for this purpose and then deleted or anonymized.
Cookies
Like most websites, rescreativa.org may use cookies, small text files stored on your device that help the site function and let us understand how it’s used.
• Essential cookies are required for the site to work properly (for example, remembering form entries) and do not require consent.
• Analytics and other non-essential cookies, if used, are only set with your consent, which you can give or withdraw through a cookie banner or your browser settings.
You can also control or delete cookies through your browser settings at any time. Blocking cookies may limit some site functionality.
Contact and Other Forms
When you submit a form on rescreativa.org, such as a founder intake form or a general contact form, we collect the information you provide, which may include your name, email address, and any message content.
We use this information only to respond to your inquiry or process your request. We do not use form submissions for marketing unless you separately opt in.
This processing is based on your consent (Art. 6(1)(a) GDPR) and, where the inquiry relates to a request you’ve made, on our legitimate interest in responding (Art. 6(1)(f) GDPR). We retain form submissions only as long as needed to address your inquiry, unless a longer period is required by law.
Comments
If we enable comments on our posts, the data you enter in the comment form, along with your IP address and a browser-identifying cookie, is collected to help us detect spam and, where necessary, resolve legal disputes.
Any information beyond your name and comment text is optional. Your comment and its metadata are retained indefinitely so that we can recognize and approve follow-up comments automatically rather than holding every comment for manual moderation.
This processing is based on our legitimate interest in maintaining a functional and spam-free comment system (Art. 6(1)(f) GDPR) and, where applicable, your consent to the comment being publicly displayed.
If you leave a comment, you may request that we delete your personal data, including removal of the comment, subject to our legitimate interest in retaining records where legally required.
Embedded Content
Pages on this site may include embedded content, such as video, images, or articles from other websites. Embedded content from other sites behaves exactly as if you visited that other site directly. These sites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction if you have an account and are logged in to that site.
Newsletter
If you subscribe to the Res Creativa newsletter, we collect your email address along with information confirming that you own that address and have agreed to receive the newsletter. We do not collect anything beyond this except on a voluntary basis.
Our Newsletter Provider: MailPoet
We use MailPoet to send our newsletter, a service operated by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA.
The data you submit when subscribing is stored on our servers and shared with MailPoet so it can deliver and process your newsletter data through the MailPoet Sending Service. More information is available at mailpoet.com.
How MailPoet Analyzes Newsletter Data
MailPoet lets us see whether a newsletter was opened and which links were clicked, so we can tell which content resonates most.
We can also track whether a subscriber took a specific action after opening or clicking, such as making a purchase, which we use to measure conversion.
MailPoet additionally allows us to group subscribers by category, for example by age, gender, or location, so we can tailor content to different audiences. If you would rather not be included in this kind of grouping, you can unsubscribe using the link provided in every newsletter.
Further detail on MailPoet’s functionality is available at account.mailpoet.com and mailpoet.com/mailpoet-features. MailPoet’s own privacy policy is at automattic.com/privacy.
Legal Basis
We process this data based on your consent (Art. 6(1)(a) GDPR). You may withdraw consent at any time, effective going forward, by unsubscribing.
Transfers of data to the US rely on the European Commission’s standard contractual clauses. Automattic is also certified under the EU-US Data Privacy Framework (DPF), an agreement requiring US companies to meet European data protection standards. More information is available at dataprivacyframework.gov.
How Long We Keep This Data
We retain your subscription data until you unsubscribe, at which point it is removed from our distribution list or deleted once its purpose has been fulfilled. We reserve the right to delete addresses under our legitimate interest (Art. 6(1)(f) GDPR) where necessary for list hygiene or deliverability. Data we hold for other purposes is not affected by this.
After you unsubscribe, we may retain your email address on a suppression list to prevent future mailings. This list is used only for that purpose and is never merged with other data. Retention on this list is indefinite, though you may object if your interest in removal outweighs our legitimate interest in maintaining it (Art. 6(1)(f) GDPR).
Data Processing Agreement
We maintain a data processing agreement (DPA) with MailPoet, a contract required under data privacy law that ensures they process visitor data only on our instructions and in compliance with the GDPR.
Your Rights Under GDPR
If you are located in the European Union or European Economic Area, you have the right to:
• Access the personal data we hold about you
• Rectify inaccurate or incomplete data
• Erase your data (“right to be forgotten”), subject to legal retention requirements
• Restrict how we process your data
• Data portability, receiving your data in a structured, commonly used format
• Object to processing based on legitimate interest, including direct marketing
• Withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal
• Lodge a complaint with a supervisory authority in your EU member state if you believe your data has been mishandled
To exercise any of these rights, contact us at contact@rescreativa.org.
International Data Transfers
Because we are based in the United States and use US-based service providers such as Automattic/MailPoet, personal data from EU and EEA visitors may be transferred outside the European Economic Area. Where this occurs, we rely on appropriate safeguards, including the European Commission’s standard contractual clauses and, where applicable, provider certification under the EU-US Data Privacy Framework.
Data Retention
We retain personal data only as long as necessary for the purposes described in this policy, or as required by law. Where no specific retention period is noted above, we delete or anonymize data once it is no longer needed for the purpose it was collected for.
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The date of the most recent revision will be noted at the top of this page. We encourage you to review this page periodically.
